BARTON COUNTY OPEN BURNING
Barton County Open Burning Requirements for Resolution No 2004-05
Applicants must contact nearest fire department prior to initial burn to obtain permit.
Current burn permit must be on site when burning
The Authority having Jurisdiction may make on-site inspection of burn site at any time.
911 Communications Officer must be notified of burn location each day prior to burning at (620)-793-1920. At the time of notification, 911 will advise if any burn restrictions are in place.
Wind speed must be less than 15 M.P.H.
Responsible persons shall be present when burning is conducted.
Fire protection, connected garden hose, water hand pump, wet sacks, and / or water tank, etc. must be provided.
Fire must be completely out one (1) hour before sundown.
Burning must not create dense smoke, smoke nuisance, or a traffic hazard.
Burning must be in compliance with Barton County Resolution 2004-05 and KAR 28-19-645 through 28-19-648
There will be no burning without a special permit during burn bans.
No Burning shall be allowed within City limits unless The Fire Chief or his / her designee, having jurisdiction of that city, provides a special permit.
The person signing this document is solely responsible for liability for any damages caused by burning and agrees to indemnify and hold harmless any City or County agency for damages resulting from burning.
Violation of Resolution 2004-05 by any person shall be punishable as a Class B Misdemeanor with penalties for each separate offense by a term of confinement in the Barton County Detention Facility not to exceed six months and / or a fine in an amount not to exceed One Thousand Dollars ($1,000.00). Any person who aids, assists, or abets another in violating the provisions of Resolution 2004-05 will be deemed to have committed a violation of the Resolution.
In accordance with Resolution 2004-05 any responding agency will have the right to collect restitution for any expenses incurred by the agency as caused by violation of the permit by said holder.
